EXTENDED  DACA for DREAMERS

On June 15, 2012, President Barack Obama announced that the U.S. Department of Homeland Security (DHS) would not deport certain undocumented youth who had come to the United States as children. Under a directive from the secretary of DHS, these youth may be granted a type of temporary permission to stay in the U.S. called “deferred action.” The Obama administration called this program Deferred Action for Childhood Arrivals, or DACA.

On November 20, 2014, President Barack Obama The president also announced an expansion of the Deferred Action for Childhood Arrivals (DACA) program for youth who came to the United States as children.

WHAT IS EXTENDED/EXPANDED DACA & WHO IS ELIGIBLE TO APPLY:

The expanded DACA has taken the cap on age requirement away which was originally placed when original DACA was announced in 2012. Previously on people under 31 years of age could apply for the relief. This limitation is now taken away and now a person of any age can apply as long as s/he meets the remaining criteria listed below:

To be eligible for the expanded DACA program, you must:
  •  Have come to the United States before your sixteenth birthday.
  •  Have continuously lived in the U.S. since January 1, 2010.
  •  Have been present in the U.S. on November 20, 2014, and every day since then.
  •  Not have a lawful immigration status. To meet this requirement, your lawful immigration status must have expired before November 20, 2014; and  you must not have a lawful immigration status at the time you apply for expanded DACA.
  •  Have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or “be  in school” on the date that you submit your deferred action application.
  •   Have not been convicted of certain criminal offenses.
  •   Pass a background check.
